California's proposal No. 65, the drinking water safety and toxic substances Enforcement Act of 1986, was issued in November 1986. Its purpose is to protect the drinking water sources of California residents and the state, so that the water sources do not contain substances known to cause cancer, birth defects or other reproductive development hazards, and to inform the residents truthfully when such substances appear in the products. California 65 list of controlled substances is issued by OEHHA and updated quarterly. It was first published in 1987. The new list contains more than 900 substances.
Core control requirements:
1. No water pollution: no one shall intentionally discharge or release carcinogenic or reproductive toxic substances known to California into the water source or put them on or in the land that may pollute the water source.
2. Warning requirements: after a chemical substance is listed in the control list, the manufacturer and distributor shall complete the implementation of the warning within 12 months, and terminate the discharge of the chemical substance to the source of drinking water within 20 months. After this date, the government or individual law enforcers, including individuals or organizations representing the public interest, can take action against those who violate the regulations. Warning requirements must be "clear and reasonable" and can be in various forms.
3. Limit requirements for hazardous substances: the California act 65 control list itself does not set limits for substances. For the control limits of hazardous substances in products, referring to the existing lawsuits or agreements for such products, the limit requirements and test methods for certain substances in certain products may be reached in these documents.
4. In the process of product control, enterprises should first compare the material control requirements determined in the existing litigation cases of such products, and then refer to this control to investigate the harmful substances in the products.
